Stage 4: Submission to the ACMA

Update, November 2025: On 24 November 2025, the ATA submitted a revised draft Code  to the ACMA for its consideration. The revised draft addresses the issues raised in the ACMA’s Notice of Deficiencies (23 October) and Statement of Reasons (31 October) letters. The ATA also provided a cover letter outlining the changes in the revised draft.

Given the requirement to respond to the ACMA’s Notice of Deficiencies within 30 days, the revisions to the draft Code were made by the TCPC Drafting Committee and approved by the ATA Board of Directors. As the Code has been through an extensive and iterative public consultation process throughout drafting, the ATA was advised that public consultation requirements for the Code had already been met, allowing the revised draft to be submitted within the required timeframe.

Update, October 2025: On 23 October, ACMA wrote to the ATA to advise of its decision to not register the draft TCP Code submitted to it in May for registration. It also gave Notice under section 125 of the Telecommunications Act 1997 requesting that the ATA addressed deficiencies in the 2019 TCP Code within 30 days.

On 31 October, ACMA provided a Statement of Reasons to further explain its decision.

The ATA intends to respond to the ACMA within the 30 days.

Update, August 2025: On 9 July ACMA wrote to the ATA seeking additional information: ACMA 9 July letter. The ATA responded on 1 August: ATA 1 August letter.

Between February and May 2025, the TCP Code Drafting Committee (DC) comprehensively reviewed and considered numerous inputs provided on the draft TCP Code.

On 19 May 2025, the Australian Telecommunications Alliance submitted an updated draft TCP Code to the ACMA for consideration. A media release was issued on 20 May.

For transparency, including to allow submitters to understand how and why their comments have been managed in the way that they have, the following documents are available for review:

  1. Updated TCP Code 2025, as submitted to the ACMA for consideration.
    • Note:
    • This is a draft Code, provided for visibility only. Further changes may be made and/or the Code may not be registered by the ACMA. The current 2019 Code will remain in effect until advised otherwise.
    • A ‘track changes’ copy of the same document, showing updates made since the public comment version, is available on request.
  2. Comment log, public comments on the ‘public comment draft’. Submitters are encouraged to consider others’ comments to assist them understand responses made.

Public consultation on draft DR C628:2025: TELECOMMUNICATIONS CONSUMER PROTECTIONS CODE closed on 28 February 2025.
